1. About These Terms
These Terms of Service ("Terms") are a contract between you and Maksim Paleyeu, trading as Relax Games ("we", "us"), whose details are in Section 21 and in our Legal Notice. They cover the game Twist & Merge: 3D Number Cube (the "Game") on iPhone and iPad (iOS and iPadOS), on Mac computers with Apple silicon (macOS) and on Android, including its online services and in-app purchases.
You accept these Terms when you download or start using the Game. If you do not accept them, please do not use the Game.
How we use your personal data is explained in our App Privacy Policy. That policy is information for you, not part of this contract, and you do not agree to it by playing.
If you are a consumer, nothing in these Terms takes away the rights consumer law gives you. Where these Terms say "as far as the law allows" or similar, the mandatory law of the country where you live decides what is allowed.
2. How the Contract Is Made
- Steps. You enter into this contract when you download the Game from the App Store or Google Play and start using it. You buy in-app items through the store's checkout, which shows you the item and its price, including any taxes, and asks you to confirm before you pay.
- Correcting mistakes. Until you confirm a purchase at the store's checkout, you can check it and cancel it. After that, see Section 9.
- Language. These Terms, and the contract, are in English.
- Keeping a copy. We do not file a separate copy of the contract for each player. The current Terms are always available at relaxgames.studio/terms-of-service, where you can save or print them, and the store sends you a receipt for each purchase. If you need an earlier version of these Terms, ask us.
3. Changes to These Terms
We may change these Terms for a valid reason: to reflect changes in the law or in the rules of the App Store or Google Play, to reflect changes to the Game's features, or to prevent abuse or improve security.
We will tell you about any change that affects you, in the Game or by other reasonable means, at least 30 days before it takes effect. Changes required by law may take effect sooner, and changes only in your favour may take effect at once. The date at the top of this page shows when these Terms last changed.
If you do not agree to a change, you can stop using the Game and delete your data at any time (see Section 15). Changes never apply to purchases you completed before they took effect.
4. Changes to the Game
We keep improving the Game, so it will change over time. We may add, change or remove features, levels and rewards, and change what items cost in coins or diamonds. We do this for valid reasons, for example to fix bugs, keep the Game balanced and fair, meet legal or store requirements or add new content, and it costs you nothing.
If a change has more than a minor negative effect on your access to, or use of, content you paid for, we will tell you clearly in advance. You can then end the contract free of charge within 30 days of the change and get a proportionate refund for the paid content you can no longer use, unless we let you keep that content without the negative effect.
Some updates are needed to keep the Game working. Old versions of the Game, and devices or operating systems that are no longer supported, may stop working with our online services.
5. Who Can Play
You may use the Game if you are at least 13 years old. If you are under 18 (or under the age of majority where you live), you need permission from a parent or guardian, who is responsible for your use of the Game and for any purchases you make.
In the European Economic Area (EEA), if you are under the age at which you can consent to the use of your personal data in your country (14 in Spain, and between 13 and 16 elsewhere in the EEA), the privacy choices in the Game, such as consent to personalised ads, must be made or authorised by your parent or guardian.
6. Your Licence to Use the Game
We give you a personal, non-exclusive, non-transferable licence to download and use the Game on devices you own or control (iPhone, iPad, a Mac with Apple silicon, or an Android device), for your own non-commercial entertainment. The licence lasts until this contract ends (Section 15). The Game is licensed to you, not sold. The usage rules of the App Store and Google Play also apply (Section 20).
7. Rules of Use
You agree not to:
- copy, modify, adapt, translate, reverse engineer, decompile or disassemble the Game, or create derivative works from it, except where the law expressly allows it (including under Article 6 of Directive 2009/24/EC);
- remove or change any copyright, trademark or other notice in the Game;
- use the Game for any commercial purpose;
- use cheats, exploits, bots, automation, hacks, mods or any other unauthorised tools that change or interfere with the Game;
- interfere with, disrupt or overload the Game's servers or networks;
- knowingly use a bug, glitch or design flaw to gain an unfair advantage (please report bugs to us instead);
- try to access other players' accounts, or our systems, without permission;
- sell, rent, lend or transfer your account or the Game to anyone else; or
- use the Game in breach of any law.
If you break these rules, we may act as described in Section 15.2.
8. Your Account and Game Data
8.1 Online play
When you play online, the Game creates an account for you with Unity Gaming Services, our provider of online services. The account is anonymous: it has a random Player ID and needs no name, email address or password. Your progress, your wallet and your items are saved to this account.
8.2 Game Center and Google Play Games
If you are signed in to Apple Game Center or Google Play Games, the Game links your account to it, so you can continue on another device signed in to the same Game Center or Google Play Games account. Those services are governed by Apple's or Google's own terms. Your display name from them is shown on the Game's public leaderboards (Section 13).
8.3 Offline mode
You can choose Play Offline in the Game. An offline game is separate from your online game: it is saved only on your device, it has no ads, shop or leaderboards, and its score and rewards never move to your online game. If you uninstall the Game or lose your device, your offline game is lost.
8.4 Keeping your progress safe
Please keep your device and your Game Center or Google Play Games account secure. If you lose access to both your device and the account you linked, we may not be able to restore your progress. You can delete your account and data at any time (Section 15.1).
9. In-App Purchases
9.1 What you can buy
- No Ads: a one-time purchase that removes the ads that appear on their own (banner, interstitial and native ads). Rewarded ads, which you choose to watch for a reward, stay available.
- Diamond packs: diamonds, the Game's premium currency (Section 10).
- Tip versions: some items are also offered with a tip, for example "No Ads + 10% tip". A tip version gives you exactly the same item. The extra amount is a voluntary tip to support the developers, and it gives you nothing more in the Game.
9.2 Prices and payment
Purchases are made and paid for through the App Store or Google Play, under their terms. Before you confirm, the store shows the price in your local currency, including any taxes. Prices may differ between countries and may change, but a change never affects a purchase you have already made.
9.3 Your right of withdrawal (consumers in the EU, the EEA and the UK)
As a consumer in the EU, the EEA or the UK, you normally have the right to withdraw from a contract for digital content within 14 days, without giving any reason.
In-app items are digital content that is delivered as soon as your purchase is confirmed. You lose the right of withdrawal for an item once its delivery has begun if, before buying, you expressly agreed to immediate delivery and acknowledged that you would lose the right of withdrawal, and you then received confirmation of this (Article 16(m) of Directive 2011/83/EU; in Spain, Article 103(m) of the consumer protection law, TRLGDCU). If that has not happened, you can withdraw within 14 days of the purchase by telling Apple, Google or us clearly that you wish to withdraw.
Apple and Google may also offer refunds under their own policies.
9.4 Refunds and faulty items
Payments are processed by Apple or Google, so refunds are made by them. You can ask for one through Apple or Google Play.
If an item you bought is not delivered or does not work as described, tell us at hello@relaxgames.studio and we will deliver it again or fix the problem. If we cannot do that within a reasonable time, you are entitled to the remedies consumer law gives you, such as a price reduction or ending the contract with a refund. Nothing in these Terms affects your legal guarantee (Section 16).
9.5 Restoring purchases
No Ads is linked to the Apple Account or Google account you used to buy it. To get it back on a new device or after reinstalling, sign in to the same store account and use Restore Purchases in the Game's Settings. Diamonds you receive for a purchase are kept in your online game account (Section 8), not by the store.
10. Virtual Currency and Items
10.1 What they are
The Game has virtual currencies and items: coins, diamonds, boosts and other items that you earn by playing or receive for a purchase ("Virtual Items"). Virtual Items can only be used in the Game. They have no value outside it and cannot be exchanged for money, sold, transferred to another player or moved to another game, except where the law requires otherwise. You receive a licence to use them under these Terms.
10.2 How we treat them
- Virtual Items you have bought do not expire while the Game's online services are available.
- We may change the Game's balance, such as how many coins a reward gives or what an item costs in coins or diamonds (Section 4). We will not remove or reduce Virtual Items you have bought or earned, except to correct an obvious error (for example, items credited by a bug), in case of fraud or cheating, or where the law requires it.
- If we decide to close the Game's online services, we will announce it in the Game at least 30 days in advance and stop selling diamonds from the day of the announcement. You keep the remedies consumer law gives you for paid content you can no longer use.
11. Fortune Wheel and Random Rewards
The Fortune Wheel gives you a random boost. You can spin it with a free daily spin, by watching an ad, or by paying diamonds. Before a spin paid for with diamonds, the Game shows the probability of each reward. The probabilities can differ between free, ad and paid spins, and we may change them; the Game always shows the current probabilities before a paid spin. The size of a sector on the wheel does not show its probability.
12. Advertising
The free Game shows ads from third-party advertising partners: banner, interstitial (full-screen), native and rewarded ads. Rewarded ads are optional: you choose to watch them for a reward, such as a boost or a spin. We do not endorse the products advertised. If an ad seems inappropriate, please tell us. No Ads removes all ads except rewarded ads (Section 9.1).
How ads use your data, and your choices, including consent to personalised ads, are explained in the App Privacy Policy.
13. Leaderboards
The Game has public leaderboards, including for speed runs. Your scores and times appear on them with your player name: your Game Center or Google Play Games display name (without spaces) if you are signed in to one of them, or otherwise a random name generated automatically. Anyone who plays the Game can see them. We may remove results that we reasonably believe were achieved by cheating, and names that are offensive or unlawful.
14. Intellectual Property
14.1 Ownership
The Game and everything in it, including its software, graphics, 3D models, animations, sounds, music, text and design, belong to us or to our licensors and are protected by intellectual property laws. Apart from the licence in Section 6, these Terms give you no rights in them.
14.2 Names and logos
"Twist & Merge", "Relax Games" and their logos are names and marks used by Maksim Paleyeu. You may not use them without our written permission, except to refer to the Game honestly.
14.3 Feedback
If you send us ideas or suggestions about our games ("Feedback"), you give us a free, worldwide, non-exclusive and perpetual licence to use, adapt and build on them in our games and our business, without owing you payment or credit. You keep any rights you have in your Feedback. Please do not send us anything you do not have the right to share.
15. Ending the Contract
15.1 By you
You can stop using the Game at any time by uninstalling it. To delete your account and data, use Settings → Delete My Data in the Game or email us; see Delete Your Account and Data. Deleting your account ends this contract.
15.2 By us
We may suspend or close your account, or end this contract, if you seriously or repeatedly break these Terms, commit fraud or cheat, or if the law requires us to. Our response will be proportionate to what happened. We will tell you why and give you a chance to respond, unless that would be unlawful or would harm security or an investigation. If we close your account because you broke these Terms, you lose the Virtual Items linked to it. If we close it for any other reason, you keep the remedies the law gives you for content you paid for.
15.3 If we close the Game
We may stop offering the Game or its online services. We will tell you in the Game at least 30 days in advance (Section 10.2).
15.4 What continues after the contract ends
Sections 14 (Intellectual Property), 16 (Our Responsibility to You), 17 (Indemnity) and 18 (Law and Courts) continue to apply.
16. Our Responsibility to You
16.1 Your legal guarantee
If you are a consumer, the law guarantees that the Game and the content you buy conform to the contract: they must be as described, fit for their purpose, and receive the updates needed to keep them working as described (Directive (EU) 2019/770 and, in Spain, the TRLGDCU). Nothing in these Terms limits that guarantee.
16.2 Availability
Beyond that guarantee and what these Terms say, we make no other promises about the Game. In particular, as far as the law allows, we do not promise that the Game will always be available, uninterrupted or free of errors. Online features need an internet connection and may be interrupted for maintenance or for reasons outside our control.
16.3 Liability
We are responsible for foreseeable loss and damage caused by our breach of these Terms or by our failure to use reasonable care and skill. Loss or damage is foreseeable if it is an obvious consequence of our breach, or if you and we had it in mind when the contract was made. We are not responsible for loss or damage that was not foreseeable, that was caused by events outside our reasonable control, or that you could have avoided by following our reasonable advice (for example, by installing a free update).
Nothing in these Terms excludes or limits our liability where the law does not allow it, including for death or personal injury caused by our negligence, for fraud, for damage caused intentionally or through gross negligence, or under the legal guarantee and other mandatory consumer rights.
If you use the Game other than as a consumer, we are not liable for loss of profit, business or revenue, and our total liability to you is limited to the greater of what you paid us in the 12 months before the claim and EUR 50.
16.4 Other companies' services
The App Store, Google Play, Game Center, Google Play Games and our advertising partners are run by other companies under their own terms. We are not responsible for their services, except where a problem is caused by us.
17. Indemnity
If you use the Game other than as a consumer, you will compensate us for claims, losses and reasonable costs (including legal fees) that arise from your breach of these Terms or of the law. This section does not apply to consumers.
18. Law and Courts
These Terms are governed by Spanish law. If you are a consumer, you also keep the protection of the mandatory provisions of the law of the country where you live.
If you are a consumer, you can bring a claim in the courts of the place where you live or in the courts of Valencia, Spain, and we can bring a claim against you only in the courts of the place where you live. If you are not a consumer, the courts of Valencia, Spain, have exclusive jurisdiction.
If you have a complaint, please email us first at hello@relaxgames.studio so that we can try to resolve it. If we cannot, we will tell you whether we agree to use an alternative dispute resolution body. You can also contact the consumer authorities or consumer associations where you live.
19. General Terms
- Severability. If a court decides that part of these Terms is invalid, the rest stays in force.
- Entire agreement. These Terms, together with any additional terms shown in the Game for a specific feature or offer, are the whole agreement between you and us about the Game. This does not affect your rights as a consumer.
- Transfer. We may transfer this contract to another person or company, for example if the business is incorporated or sold, as long as your rights under these Terms are not reduced. We will tell you if this happens. You may not transfer your rights under these Terms without our written consent.
- No waiver. If we do not enforce a right straight away, we can still enforce it later.
20. App Store and Google Play
Your use of the Game is also subject to the terms of the store you got it from:
- Apple App Store: Apple Media Services Terms and Conditions
- Google Play: Google Play Terms of Service
If they conflict with these Terms on store matters, such as payments and store refunds, the store's terms prevail.
20.1 Additional terms for the Apple App Store
If you downloaded the Game from the Apple App Store, you acknowledge and agree that:
- These Terms are concluded between you and us only, not with Apple Inc. ("Apple"), and we, not Apple, are solely responsible for the Game and its content.
- Apple has no obligation whatsoever to provide any maintenance or support services for the Game.
- If the Game fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) paid for the Game to you; to the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the Game.
- Apple is not responsible for addressing any claims by you or any third party relating to the Game, including product liability claims, claims that the Game fails to conform to any legal or regulatory requirement, and claims under consumer protection, privacy or similar legislation.
- If a third party claims that the Game, or your possession and use of it, infringes that third party's intellectual property rights, we, not Apple, are solely responsible for the investigation, defence, settlement and discharge of that claim.
- You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms, and once you accept these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce them against you as a third-party beneficiary.
